Cop accused of punching woman in face employs ‘sleepwalking’ defense

A cop accused of breaking into a woman’s apartment in his underwear and pummeling her – just hours after he received the NYPD’s esteemed Combat Cross – says he was sleepwalking during the attack, and says he didn’t report the late night incident because he thought it was a “dream.”
“Our report shows that it wasn’t an alcoholic blackout. It was sleepwalking,” defense attorney Michael Marinaccio said after Eugene Donnelly’sappearance in Bronx Supreme Court Tuesday on charges of misdemeanor assault and burglary charges for the odd June 11, 2014 attack.
Marinaccio says his client has been diagnosed with PTSD and a variety of sleep disorders since the 2012 shooting that won him the medal — the NYPD’s second highest honor — and that he had “no recollection about what happened” that night after falling asleep at a friend’s.
“He doesn’t know how he got there, he was in his underwear, no shirt, bare feet — it doesn’t make sense,” the lawyer said. “On that day he decided to become a rowdy, drunken criminal?”
“He didn’t recognized himself and what was going on,” Marinaccio said.
Attorney Michael Marinaccio says he gave Bronx prosecutors notice of the sleepwalking defense last October, but griped Tuesday that they were ambushing him by suddenly announcing they were hiring experts.
“We raised the psychiatric defense,” Marinaccio said. “Now they are hiring doctors? There is no excuse for that.”
The attorney objected to the examinations, butthe judge denied his request, and said prosecutors could move forward and have the officerexamined by their experts.
“Shhh, It’s OK. Just put a shirt on,” the cop allegedly said when the startled tenant awoke.
“Sometimes I’m a good guy, but sometimes I’m a bad guy,” he told the woman, according to a criminal complaint.
After chugging some milk from her fridge, Donnelly then repeatedly punched the 30-year-old woman in the face — before dragging her into the bedroom where he continued punching her in the face and head.
Donnelly, who declined comment, is due back in court April 21.
