To the Sergeants who took the 2015 Examination for Lieutenant, Exam # 5535:
As you know, a lawsuit has been filed by a small number of sergeants who took the exam, requesting that it be invalidated and that no promotions be made from the list. The City Law Department is defending the case. Yesterday it informed the plaintiffs that it is the New York City Police Department’s intention to begin making promotions from the eligible list. The NYPD and the City will now wait to hear whether the court will allow or prohibit this.
With regard to the test, the Department of Citywide Administrative Services (DCAS) has certified the list of eligible promotes. Because it was certified, that decision cannot be revisited, and the list will not be revised. I know this is unwelcome news for those sergeants whose scores were in the high 60s.
Questions have been raised about this exam. The Department has begun to investigate those questions over which it has jurisdiction. Other questions must be left to other controlling agencies, such as DCAS and the Department of Investigation (DOI).
The NYPD’s investigation is centered on officers’ requests to take the exam on makeup dates, and the validity of those requests. We have already discovered inconsistencies in several requests. The individuals who made those invalid requests will not be promoted.
The following is the Department’s intended course of action relative to Exam 5535:
1) The NYPD will proceed with promotions from the active list for Exam 5535, unless prohibited by the court.
2) The NYPD reminds sergeants promoted from the list that their rank of Lieutenant is probationary for one year after promotion.
3) The NYPD will continue to investigate the nature of excusal requests associated with Exam 5535.
4) The NYPD will work with DCAS to end Saturdayexaminations, thus removing the need for most excusals.
5) The NYPD will cooperate with DCAS and DOI in any investigations they conduct.
I am sending this in order to ensure that the information you receive about the exam is accurate and timely, and not shared piecemeal through the media or third parties. As frontline supervisors and indispensable members of the Department’s operations, you deserve no less, and I will continue to keep you apprised of new developments if they occur.
